Landlord Didn't Serve Initial Registration

Facts: Landlord sued to evict rent-stabilized tenant for nonpayment of rent. Tenant claimed that landlord had collected a rent overcharge. The apartment had been rent-controlled until late 1990. Landlord then renovated the apartment at a cost of $11,700 while it was vacant. The first stabilized rent was $585. Tenant was the third stabilized tenant but landlord had never served the initial DHCR apartment registration form on any tenant. The trial court found that since there was no initial rent registration, the legal rent was the last rent-controlled rent of $121.60. Landlord appealed.
