Landlord sued to evict rent-stabilized ETPA tenant for nonprimary residence. The court granted tenant's request to dismiss the case. Landlord didn't send the lease nonrenewal/termination notice during the period between 90 and 120 days before expiration of tenant's current lease. This failure to comply with ETPR Section 2503.5(a) required dismissal of landlord's eviction petition.
