Landlord Didn't Send Termination Notice to Section 8 Tenant

LVT Number: 6746

Landlord sued to evict tenant in federally subsidized housing project based on illegal use of the apartment. Landlord claimed that tenant was operating a "crack house.'' Tenant claimed that landlord's petition was defective because landlord didn't serve him with a notice of termination. The court agreed and dismissed landlord's petition. Written notice of termination was required, even though eviction was sought for tenant's illegal use of the apartment.
