Landlord Didn't Send NYCHA Copy of Eviction Petition

Landlord sued to evict tenant. Tenant asked the court to dismiss the case. Tenant received a Section 8 voucher from NYCHA and landlord failed to comply with the Williams consent decree or properly state tenant's Section 8 status in his court papers. The court ruled for tenant. Landlord served copies of the 30-day termination notice and court petition on NYCHA by certified mail only.

The court ruled for tenant. Landlord served copies of the 30-day termination notice and court petition on NYCHA by certified mail only. But the Williams consent decree required landlord to send NYCHA copies of these papers in a case not arising from termination or suspension of the Section 8 subsidy or termination of a HAP contract by state law requirements or overnight mail.
