Landlord Didn't Renew Lease on Time

Tenant complained of an improper rent-stabilized lease renewal. The DRA ruled for tenant and adjusted the lease offered to tenant on May 30, 2002, to reflect a start date of Sept. 1, 2002. Tenant appealed, claiming that the renewal lease should start on a later date. The DHCR ruled for tenant. Landlord never signed or returned to tenant the renewal lease offered on May 30. Instead, landlord offered tenant a second renewal lease dated Oct. 2, 2002, which landlord signed and returned to tenant. So the effective date of tenant's renewal lease was Jan. 1, 2003.
