Landlord Didn't Prove Legal Monthly Rent of $2,000 or More

LVT Number: 16881

Landlord sued to evict three building tenants and claimed that they were unregulated. Each of the tenants had moved into the building in the 1990s and paid monthly rents of over $2,000. The court ruled against landlord. Landlord had never filed luxury deregulation forms with the DHCR and had never registered the apartments. Since landlord hadn't complied with proper regulation procedures, it couldn't prove that tenants were paying monthly legal regulated rents of $2,000 or more.
