Landlord Didn't Prove Installation Date

Landlord applied for MCI rent hikes based on a number of improvements. The DRA ruled for landlord in part, but disallowed $80,000 for a boiler installation because landlord's application had been filed more than two years after the work was completed. Landlord appealed, claiming that the work was completed in March 2005. Its application was filed within two years after that date. The DHCR ruled against landlord.

The DRA ruled for landlord in part, but disallowed $80,000 for a boiler installation because landlord's application had been filed more than two years after the work was completed. Landlord appealed, claiming that the work was completed in March 2005. Its application was filed within two years after that date. The DHCR ruled against landlord. The DRA correctly determined that the completion date for the boiler/burner installation was the date of the issuance of the Certificate of Electrical Inspection and that the work was completed in 2004. Landlord submitted no contrary proof of the completion date for the installation.
