Landlord Didn't Prove Extension Existed When She Bought Building

LVT Number: 19474

DOB issued a violation notice to landlord for work without a permit. The notice stated that there was an extended room off the rear of the building. Landlord said that the extension was there when she bought the building. She submitted a survey showing a structure behind the house. The ALJ ruled against landlord and fined her $500. The survey was dated June 14, 1994, but landlord said she bought the house in 1993. Landlord appealed, and submitted the deed showing that she bought the house after the survey was done. ECB ruled against landlord.

The extension described in the violation notice was a 12- by 8-foot room with windows and siding.
