Landlord Didn't Prove Cooling Tower Was Properly Maintained

DOHMH issued a violation notice to landlord for failing to perform and document routine monitoring of a cooling tower and for failing to collect and analyze sampling records. Landlord claimed all required monitoring had been performed and that records were contained in a binder at the building site. The ALJ ruled against landlord and fined it $1,000. Landlord appealed and lost. Records that landlord presented to the ALJ were incomplete, and ECB wouldn't consider new evidence on appeal. [Download PDF of decision here.]
