Landlord Didn't Pay Penalty on Time

DEP issued a violation notice to landlord for having an expired boiler registration. The ALJ fined landlord $350, and she appealed. Landlord claimed that although the ALJ gave her 60 days to comply, she was assessed a late payment penalty before the 60 days were up. ECB ruled against landlord. The time periods for payment of the penalty imposed by the ALJ and for compliance with the boiler registration requirements are two separate matters. Landlord was properly assessed a 10 percent late fee for not paying the $350 penalty within 10 days.
