Landlord Didn't Overcharge Section 8 Tenant

Tenant complained of rent overcharge. He claimed that landlord charged him more than his legal share of the subsidized rent. The DRA dismissed the complaint and said that tenant should raise any complaint about his subsidized rent with the Section 8 contract administrator of the building’s Housing Assistance Payment (HAP) contract. Tenant appealed and lost. Landlord charged less than the legal regulated rent for the apartment.

And tenant’s portion of the subsidized rent may have been changed by the HAP contract administrator during the period in question. It is the responsibility of the Section 8 contract administrator to determine tenant’s portion of the subsidized rent.
