Landlord Didn't Meet Useful Life Requirements

Landlord applied for MCI rent hikes based on the installation of replacement windows. The DRA ruled for landlord, although the rent increase was adjusted to deduct the cost of a previous MCI granted for the replacement of storm windows. Tenant appealed, claiming that the new windows weren't storm windows. The DHCR ruled for tenant and revoked the MCI rent increase.

Tenant appealed, claiming that the new windows weren't storm windows. The DHCR ruled for tenant and revoked the MCI rent increase. Landlord's new application was based on the installation of new aluminum windows and screens ''for energy conservation and pest control.'' The new windows were installed less than 15 years after the installation of prior windows. The new windows didn't qualify as an MCI because they didn't meet the DHCR's useful life requirements.
