Landlord Didn't Install Backflow Prevention Device

DEP issued a violation notice to landlord for failing to install a backflow prevention device in its building. Landlord opposed the violation, but the ALJ fined it $700. Landlord appealed and lost. Landlord claimed that it had responded to each letter and order from DEP and promptly took steps to correct the violation. Landlord claimed that it wasn’t given sufficient opportunity to defend itself before the ALJ, but the record showed landlord had enough chance there to testify and present evidence. ECB refused to consider any new evidence on appeal.
