Landlord Didn't Get DOB "Stop Work" Order Removed

Landlord applied for MCI rent hikes based on the installation of new compactors and camera security. The DRA ruled against landlord, who appealed and lost. Landlord didn't get a DOB “Stop Work” order removed from DOB’s records. Landlord claimed that subsequently it had obtained DOB permits for the work performed. DOB was unable to inspect for removal of the Stop Work order because it couldn’t obtain access to the apartment involved.

Landlord didn't get a DOB “Stop Work” order removed from DOB’s records. Landlord claimed that subsequently it had obtained DOB permits for the work performed. DOB was unable to inspect for removal of the Stop Work order because it couldn’t obtain access to the apartment involved. Landlord said that the inspection had been rescheduled and that the Stop Work order should be removed shortly. The DHCR ruled against landlord, finding that landlord had obtained a number of time extensions from the DRA between August 2010 and January 2011 for submission of proof that the Stop Work order was removed but never submitted the required information either to the DRA or with its PAR.
