Landlord Didn't File Application in Time

Landlord applied for MCI rent hikes based on the installation of a new roof, pointing, and waterproofing. The DRA disallowed any increase for the roof installation because landlord had failed to file the MCI application within two years following completion of the roof installation. Landlord appealed, claiming that the "final phase'' of the roof work had begun within two years of her filing. The DHCR denied landlord's PAR. The DRA had asked landlord for information on the completion date while landlord's application was pending.
