Landlord Didn't Explain Rent Increase

Tenant complained of a rent overcharge. The DRA ruled against tenant, finding no rent overcharge. Tenant complained, questioning landlord's claimed 1/40th improvement costs. Tenant also argued that landlord didn't explain the reason for the increases over prior tenant's rent in the Rent Stabilization Rider she received with her initial lease. The DHCR agreed that the apartment improvement costs should be examined further and sent the case back to the DRA for further investigation.

But although landlord should have given tenant a rider showing how the rent was computed, the failure to do so didn't disqualify landlord from entitlement to a rent increase for apartment improvements.
