Landlord Didn't Conduct Five-Year Flow Test of Sprinkler System

The Fire Department issued a violation notice to landlord for failing to conduct a required five-year performance flow test of the building's residential sprinkler system in the presence of a Fire Department inspector. Landlord claimed that it tried to comply with a first violation issued for the same condition by scheduling the test for Aug. 8, 2013. Landlord claimed that the Fire Department inspector came to the building that day but didn't stay for the test. The Fire Department claimed that its inspector didn't stay because there was no access.

Landlord claimed that the Fire Department inspector came to the building that day but didn't stay for the test. The Fire Department claimed that its inspector didn't stay because there was no access. Landlord rescheduled the test for Dec. 18, 2013. The ALJ fined landlord $1,500 because landlord didn't show that the test had been scheduled before the first scheduled hearing date. Landlord appealed and lost. Landlord didn't dispute that no access was provided at the time of the originally scheduled test date.
