Landlord Didn't Clear Debris Often Enough

DOS issued a violation notice to landlord for having a dirty sidewalk in front of its building one afternoon at 4 p.m. The inspector found paper bags, newspapers, candy wrappers, and other debris scattered and matted all around the sidewalk. Landlord claimed that it cleaned in front of the building at 7 a.m. and in the evening every day. Landlord said the downstairs commercial tenant also cleaned at 10 a.m. and 2 p.m. The ALJ ruled against landlord and fined it $100. Landlord appealed, claiming that it made reasonable efforts to clean. ECB ruled against landlord.

The fact that there was so much garbage in front of the building at 4 p.m. when landlord testified there would have been three cleanings by that point showed that landlord's efforts were insufficient.
