Landlord Didn't Ask for Extra Time to Repair Facade

DOB issued a violation notice to landlord for not filing an amended report showing that the hazardous building conditions described in a facade inspection report had been corrected. Landlord had filed his original report on March 4, 1996. The violation notice was issued on July 18, 1996. Landlord claimed that the repairs would be completed by Dec. 1, 1996. The ALJ dismissed the violation, finding that landlord didn't have to ask DOB for extra time to complete the work.

DOB appealed, pointing out that if landlord couldn't complete the repairs within 30 days, city regulations required landlord to ask for extra time. ECB ruled for DOB and fined landlord $400.
