Landlord Deviated from Cleaning Schedule

DOS issued a violation notice to landlord for not cleaning 18 inches into the street from the curb in front of the building. Landlord objected, but the ALJ found that landlord didn't make reasonable efforts to clean in a routine manner because it deviated from its regular cleaning schedule. Landlord was fined $50 and appealed. ECB ruled for landlord and revoked the fine. Deviating from its routine in itself didn't mean landlord didn't make adequate cleaning efforts. Landlord's ``deviation'' in this case was that it made a 9:00 a.m. cleaning in addition to regularly scheduled cleanings.
