Landlord Deemed to Have Corrected Violations

Landlord applied for 1990-91 MBR rent increases. The DRA ruled against landlord, finding that he hadn't corrected the required number of building violations to get the MBR increases. Landlord appealed, claiming that he had corrected enough violations. Tenant had admitted that the violations in question were corrected, but later claimed they weren't. Since tenant didn't question that the repairs were done for at least eight months after stating that they were done, the DHCR deemed that landlord had corrected enough violations and granted the MBR increases.
