Landlord Could Restore Case Marked Off Calendar

Landlord sued to evict various rent-stabilized tenants for owner occupancy purposes. The cases were consolidated in housing court and were set for trial when the parties marked the matter off calendar after telling the court that the case was settled and they needed time to submit a written settlement agreement. Landlord later claimed that no settlement was reached and sought to restore the case to the court's calendar. Tenants opposed landlord's request. The court ruled for landlord. Ultimately, there was no settlement, and landlord sought to restore the case within one year.
