Landlord Could Continue to Charge Rent Paid Under Tenant’s Last Lease

Landlord sued to evict rent-stabilized tenant for nonpayment of rent. Tenant asked the court to dismiss the case, claiming that he had no current signed lease and deemed renewal leases were no longer permitted. The court ruled against tenant. Landlord charged tenant $1,177 per month under his last executed lease. Landlord was entitled to continue charging that amount and to sue for nonpayment on that basis. Landlord could proceed with a trial to prove its case.
