Landlord Corrected ‘Brown Water' Condition

Landlord applied for MCI rent increases based on repiping and installation of a new intercom system and mailboxes. Tenants appealed, claiming that the repiping caused brown water and other problems. Landlord answered that the brown water wasn't caused by the plumbing work. The DHCR ruled against tenants. Only three tenants raised this issue before the DRA, so only their PARs would be considered. An inspection showed brown water in two of the three apartments. One of the two tenants later stated that the water had become much cleaner.

Landlord also submitted proof that the building's water tank had been cleaned. Two independent companies also gave landlord water analysis reports indicating that the water was tested and was safe to drink.
