Landlord Collected Full Rent While Rent Reduction Order Was in Effect

Rent-stabilized tenant complained of rent overcharge. The DRA ruled for tenant and ordered landlord to refund $14,885, including interest. Landlord appealed and lost. The rent overcharge finding was based on a DHCR rent reduction order issued before the base rent date, which remained in place to date, and which froze tenant's rent at a level in effect before the base rent date.
