Landlord Cleared Enough Violations for MBR Increase

Landlord applied for 2006-2007 MBR increases for rent-controlled tenants. The DRA ruled against landlord, finding that it hadn't certified enough cleared violations to qualify for the rent increases. Landlord appealed and won. Landlord submitted proof that outstanding violations had been cured. The proof included invoices and statements from contractors who performed various jobs, including the installation of window sashes and a bathtub. Tenants also confirmed landlord's claims. Landlord proved that it had cleared all rent-impairing violations and 80 percent of all other violations.
