Landlord Claims Order Is Vague

Tenants complained of a reduction in services. The DRA ruled for tenants and reduced their rents. Landlord appealed, claiming that the DRA's service restoration order was vague with regard to the roof door alarm condition. The DHCR ruled against landlord. Tenants had made a proper complaint. Landlord then had to investigate and make the necessary repairs. If landlord had been unsure of what condition to fix to obtain rent restoration, it could have filed a Freedom of Information Law (FOIL) request with the DHCR to obtain a copy of the DHCR's inspection report.
