Landlord Claims Building Deregulated After Tax Benefits Expired

Tenant complained that she was overcharged and that landlord refused to give her a rent-stabilized renewal lease. Landlord claimed that the building was rent stabilized only while its 421-a tax benefits were in effect. Landlord claimed that the benefits had expired and the building was no longer rent stabilized. The DRA ruled for tenant. Landlord appealed and lost. The building remained rent stabilized because it was completed before Jan. 1, 1974.
