Landlord Can't Get Rent Subsidy Amount

LVT Number: 13131

Landlord sued to evict Section 8 tenant for nonpayment of rent. Landlord also sued NYCHA, demanding the rent subsidy payments the agency had suspended because of uncorrected hazardous conditions in the apartment. The court and appeals court ruled against landlord. The housing court had no authority to review NYCHA's decision to stop payments to landlord. And landlord could sue tenant only for tenant's portion of the rent, not the subsidy amount.
