Landlord Can't Get Abatement for Lapsed SCRIE Tenants

Landlord received property tax abatement because a number of building tenants received rent reductions under the SCRIE program. At some point the exemptions lapsed. When discovered, NYC Department for the Aging revoked several years of landlord's tax abatements. Landlord appealed, claiming that tenants still paid reduced rents and probably still qualified for SCRIE benefits. The court ruled against landlord. Regardless of whether tenants could have qualified for SCRIE benefits, they didn't apply and there were no current exemptions in effect.
