Landlord Can't Evict Hotel Tenant for Not Renewing Lease

Landlord sued to evict rent-stabilized tenant for refusing to renew her lease. Tenant claimed that she didn't have to renew because she was a hotel tenant. Landlord argued that tenant wasn't a hotel tenant because the building wasn't an SRO and the apartment had a bathroom. The court ruled for tenant and dismissed the case. Tenant is a permanent hotel tenant under the Rent Stabilization Code definition and so isn't required to renew a written lease.
