Landlord Can Replace Oven with Used Appliance

Rent-stabilized tenant complained of a reduction in services. The DRA ruled against tenant after inspection. Tenant appealed and lost. Tenant claimed that landlord wouldn't replace the oven in the kitchen with a new appliance. But the Rent Stabilization Code requires only that landlord make any necessary repairs or replace the oven with a comparable used or reconditioned appliance. Otherwise, if tenant wants a new oven and consents in writing, the code permits landlord to increase tenant's rent by 1/40th of the cost.
