Landlord Can Replace Metal Keys with Key Fob System

Landlord appled to the DHCR for permission to modify building services by replacing a traditional metal key with an electronic key fob system at the building's entrance door. The DRA ruled for landlord. Rent-stabilized tenant appealed and lost. Tenant argued that the key fob system wasn't an improvement to the traditional metal key, that he wouldn't use the key fob on the Sabbath, that he was a G.I., and that the personal information required for the key fob violated his right to privacy under the Constitution. But tenant never raised any of these objections before teh DRA, and the DHCR wouldn't consider them for the first time on appeal.
