Landlord Can Replace Gas Stoves with Electric Stoves

Landlord asked the DHCR for permission to modify services at a rent-stabilized building by replacing gas stoves with electric ovens and stovetops. The DRA granted landlord's application. Tenants appealed and lost. Tenants claimed that there was no emergency or gas safety issues warranting the stove replacement and that they were happy with the gas stoves. If the DHCR were to uphold the DRA's decision, tenants requested that they receive energy-efficient electric ranges comparable to gas stoves.

The DHCR pointed out that the Rent Stabilization Code permitted modification of services without a change in legal regulated rents where proposed substitutions weren't inconsistent with the Rent Stabilization Law or Code.
