Landlord Can Replace Doorman with Security Cameras

Landlord asked the DHCR for permission to modify services by eliminating the 40-hour per week lobby attendant at the building entrance and replacing him with five security cameras covering common areas of the premises and the area immediately outside. The DRA ruled for landlord. Tenant appealed and lost. Tenant was concerned about whether the "ousted" doorman could find employment. But this wasn't an issue that the DHCR could rule on.

The DRA ruled for landlord. Tenant appealed and lost. Tenant was concerned about whether the "ousted" doorman could find employment. But this wasn't an issue that the DHCR could rule on. Rent Stabilization Code Section 2522.4(e)(3) permitted landlord to file an application to modify or substitute required services, at no change in the legal regulated rent, on the grounds that the proposed modification or substitution wasn't inconsistent with the Rent Stabilization Law or Code. Landlord's proposal qualified. If required services were decreased, tenant could file an application for a rent reduction.
