Landlord Can Replace Bathroom Window with Ventilating Fan

Landlord asked the DHCR for permission to modify services in rent-stabilized tenant's apartment. The DRA ruled for landlord, ruling that landlord could close up a bathroom window and install a ventilating fan there. Tenant appealed. She claimed that she was given no chance to respond, and she opposed landlord's proposal. The DHCR ruled against tenant. Landlord's proposal was not inconsistent with the requirements of the Rent Stabilization Code, and no rent reduction was warranted. The DRA had notified tenant by mail of landlord's application.
