Landlord Can Continue to Collect Surcharge After Tenant Removes Air Conditioner

Landlord asked the DHCR if it could continue to collect an air conditioner surcharge under DHCR Operational Bulletin 84-4 when a rent-stabilized tenant in an electrical inclusion building removed an air conditioner for which he had been paying a permissible surcharge. In an opinion letter, the DHCR said yes. Also, it didn't matter whether the removal was permanent or temporary.
