Landlord Can Collect Appliance Surcharges

Rent-controlled tenant complained of rent overcharge after a recent MBR rent increase. She also claimed landlord improperly charged her surcharges for a washing machine and air conditioner. The DRA ruled against tenant, who appealed and lost. The DHCR correctly calculated tenant's current MCR to be $606. And the DHCR issued a prior order in 2006, which granted landlord a washing-machine surcharge of $13.62 per month. The DHCR also issued an order in 2006 approving an air conditioner surcharge. Tenant's complaint was properly dismissed.
