Landlord Can Amend Clerical Error in Registered Rent for 2022

In March 2024, the landlord asked the DHCR for permission to amend the legal regulated rent (LRR) listed for one apartment registered with the DHCR for 2022. The DRA denied landlord's request. Landlord appealed and won. Landlord had mistakenly registered the April 1, 2022, apartment rent as $1. Tenant's renewal lease in effect on that date listed a legal regulated rent of $1,160.09 per month. Landlord also had registered the apartment at that rent amount for several years prior to 2022. The requested registration modification was for a clerical or typographical error and was permissible with RSC Section 2528.3(c).
