Landlord Accepted Rent from Apartment Occupant

Tenant complained that landlord was trying to evict him without getting a certificate of eviction from the DHCR. Landlord claimed that tenant was an unlawful occupant who wasn't subject to ETPA coverage. The DRA ruled for tenant; tenant had paid rent to landlord in his own name since at least 1987. Landlord appealed, and the DHCR ruled against landlord. Landlord knew or should have known the identity of the occupant of the apartment. And landlord accepted rent from tenant for over three years.
