Labor Cost Increase for Super Services

Landlord applied to the DHCR for an increase in maximum collectible rent of rent-controlled tenants. Landlord claimed a labor cost increase related to services of the building super. The DRA ruled for landlord. Tenant appealed, claiming that landlord owned only his apartment and couldn't get this rent increase because the super was hired by the building's condominium association, to service the common areas. The DHCR ruled against tenant. The condo association paid the super through collection of common charges from apartment owners, including landlord.
