Items Not Listed in Tenant's Complaint

Tenant complained of reduced services. He claimed that a building fire had caused broken windows, holes in the floor and walls, peeling wall plaster, and a broken door in his apartment. Landlord answered that repairs had been made. An inspection showed a leaking kitchen faucet and a broken electrical wall switch. The DRA cut tenant's rent based on these conditions. Landlord appealed, pointing out that tenant had never complained about these two items for which the DRA cut his rent. The DHCR ruled for landlord. Tenant's complaint didn't mention these two conditions.
