Invoice Dated After Complaint Filed

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed. Landlord claimed that the DRA should have permitted some rent increase for apartment improvements. The DHCR ruled against landlord. Landlord submitted invoices and cancelled checks that were all dated after tenant had moved into the apartment. Although tenant acknowledged that landlord did the work, tenant never consented in writing to any rent increase. So landlord wasn't entitled to a rent increase for these improvements.
