Intercom Audio Not Repaired

Tenants complained of a reduction in building-wide services based on a defective intercom system. The DRA ruled for tenants and reduced their rents. Landlord later applied for rent restoration based on restored services. The DRA ruled against landlord, who appealed and lost. Although the intercom release mechanism had been restored, inspection showed that the intercom audio levels were extremely low. Landlord argued that this wasn't part of the condition that resulted in the rent reduction order.

Although the intercom release mechanism had been restored, inspection showed that the intercom audio levels were extremely low. Landlord argued that this wasn't part of the condition that resulted in the rent reduction order. But the DHCR disagreed, noting that landlord’s work order for intercom repairs included instructions that the intercom release mechanism and audible voice be repaired. The DRA also had denied landlord’s prior application to restore rent for the same reason.
