Installation of New Floor Tiles in Public Areas Is an MCI

Landlord applied for MCI rent hikes based on installation of new floor tiles in the building lobby and all of the hallways, along with installation of a new front entrance door. The DRA ruled for landlord. Tenants appealed and lost. Tenants claimed that the scope of the approved work went beyond floor tile installation. But landlord’s contract listed items that either were actual retiling of the public areas or necessary work performed in connection with the MCI. Landlord wasn’t required to submit a diagram with its application for the work done.
