Inspector Found Debris Still Falling from Terraces

Rent-stabilized tenants in New Rochelle complained of a reduction in building-wide services based on falling debris from terraces. The DRA ruled for tenants and reduced their rents. Landlord later sought rent restoration based on correction of the condition and restoration of services. The DRA ruled against landlord after agency inspection showed that there was still falling debris from terraces. Landlord appealed and lost.

Landlord later sought rent restoration based on correction of the condition and restoration of services. The DRA ruled against landlord after agency inspection showed that there was still falling debris from terraces. Landlord appealed and lost. The DHCR's inspector took photographs showing that a northeast fourth-story terrace had a small area of concrete in danger of falling, and a southeast terrace below the second story had falling concrete. So the DRA properly denied landlord's application for rent restoration.
