Inoperative Elevator

Tenants complained of a reduction in services based on an inoperative elevator. The DRA ruled for tenants and reduced their rents. Landlord appealed, claiming that on the day of the inspection, a second elevator was working and that landlord was in the process of repairing the first elevator. The DHCR ruled against landlord. There was no indication of any repair work at the time of inspection. And the fact that the second elevator was working didn't bar a finding of reduced services based on the other elevator's being inoperative.
