Initial Rent Set by HPD

Tenant complained of a rent overcharge and claimed his apartment was rent controlled. The DRA ruled against tenant. Tenant appealed and lost. Landlord had shown that the initial rent for tenant's apartment was set by HPD after the apartment was rehabilitated under the Private Housing Finance Law. So whether the amount of tenant's rent was legal was a question for HPD, not the DHCR.
