Increase Granted for Restoration of Balconies

Landlord applied for MCI rent hikes based on restoration of balconies at a cost of almost $200,000. The DRA ruled for landlord in part. The DRA found that the work qualified as an MCI but disallowed $63,000 of the costs in light of a prior MCI increase. Landlord appealed, claiming that the prior MCI work was completely different from the current work. Tenants also appealed, claiming there should be no increase given the prior work and rent increase. The DHCR ruled against both landlord and tenant. The balcony restoration work qualified as an MCI.
