Increase Granted for Reroofing Costs

Landlord applied for an MCI rent hike for reroofing of an area above the building's recreation room and lobby. The DRA denied the application, and landlord appealed. Landlord noted that in a prior case, the DHCR granted an MCI increase for reroofing over a garage area even though the main building's roof wasn't replaced. The DHCR ruled for landlord. Like landlord's building, the roof area in the prior case was on top of an area structurally connected to the rest of the building. In both cases the roofs weren't connected. Landlord's residential towers' roofs weren't in need of repair.
